Who we are and what these Terms cover
These Terms of Service ("Terms") are a contract between you and Custom Cult LLC, a New Mexico limited liability company, 900 Roma Ave NW, Albuquerque, NM 87102, USA ("Custom Cult," "we," "us"). They govern your use of customcult.com and our related services (the "Service"), your purchase of custom snowboards, and your participation in our referral and designer programs.
These Terms cover customers who design and buy boards, people who share designs, and designers who take part in our marketplace. The section called "Designer program" applies only to designers and adds to the rest of these Terms.
Our Privacy Policy explains how we handle personal information. It is part of these Terms.
This is Version 2 of these Terms. Effective date: September 22, 2026.
Accepting these Terms
You accept these Terms when you do any of the following: create an account, save a design to an account, upload an image or generate artwork, place an order, become a designer, or keep using the Service after we post a change. At checkout you confirm that you agree to these Terms and the Privacy Policy, that you are 18 or older or a parent placing the order for a rider under 18, and that custom boards are made to order and can't be returned except for defects. At designer signup you confirm that you have read and agree to these Terms.
If you do not agree, do not use the Service.
Each version of these Terms has a version number and an effective date, shown at the top of this page. The version in force when you place an order governs that order.
Who can use the Service
Anyone can use the board designer, with or without an account. You must be 18 or older, and able to enter a binding contract, to place an order or to take part in the referral or designer programs. If you are under 18, a parent or legal guardian must place any order for you, and that adult is our customer for the order. We do not knowingly create accounts for children under 13 or collect their personal information; if you believe a child under 13 has given us information, contact us and we will delete it.
You need an account to save a design, to become a designer, and to use store credit. You may check out as a guest with an email address, or create an account during checkout.
You are responsible for everything that happens under your account and for keeping your password and sign-in methods secure. Tell us right away if you think your account has been used without your permission. You may sign in with an email and password or with a supported third-party provider (Google or Apple).
You may delete your account from your account settings. Deletion is finalized after a 30-day grace period, during which you can reactivate. We keep order and payment records, including the name and address a board shipped to, as accounting, tax and product-safety law require.
Designing a board
The board designer turns the measurements and choices you enter (for example height, weight, boot length, stance, riding style and riding intensity) into a board built for you. Your board is only as accurate as the information you give us. Check your entries before you order; a board that fits the numbers you entered is not defective because the numbers were wrong.
The dimensions the designer shows you are calculated for your purchase and use of your own board. A board's exact finished dimensions may vary slightly from the displayed values within normal manufacturing tolerances.
Designs that are not saved to an account are held for a limited time and may be removed. Saved designs stay with your account. We may use adjusted copies of a saved design to help you (for example, if you ask support for a change, we may send you a link to an adjusted copy).
Sharing designs and forks
Every saved design has a share link. Anyone with the link can view the design and its artwork and can start their own design from its shape. A design started from yours is a separate copy; your original is not changed. Share links are public. Share only links you are comfortable being public, because we cannot control who a link is forwarded to, and we do not promise that a link stops working after you delete a design.
Share images and previews may carry a watermark or our wordmark.
Placing an order and when a contract forms
When you place an order, you are offering to buy the items in your cart at the prices shown. We accept your offer, and a contract for that order forms, when your payment succeeds and we send you an order confirmation email. Until then we may decline or cancel an order for any lawful reason, including a pricing or listing error, a payment problem, a suspected fraud or misuse, or a product we cannot make or ship to you. If we cancel an order we have not accepted, we refund anything you paid.
Each custom board is made to order for you. Production starts when your order is assigned to a production run, not at the moment you pay. Your order page offers a "Cancel order" button for as long as you can still cancel.
We ship to the United States, Canada, Mexico, the United Kingdom, Germany, France, Switzerland, Austria, Italy, Spain, Sweden, Norway and Australia. Checkout will not accept an address elsewhere.
Prices, taxes, shipping and duties
Prices are in US dollars. The price of a custom board is shown in the board designer and again at checkout and includes the calculated build, the designer's algorithm and the topsheet graphic you chose.
Sales tax, VAT or GST is calculated at checkout based on your shipping address and is shown before you pay. Shipping is charged by destination zone and is shown before you pay.
If you order from outside the United States, your order may be subject to import duties, customs fees and taxes charged at delivery. Those charges are yours to pay and are not included in our price. If a shipment is refused or returned because duties were not paid, we may deduct return shipping and duties from any refund we give.
We try to keep prices accurate. If a price is clearly wrong, we may cancel the order and refund you rather than sell at the wrong price.
Paying over time
At checkout you may be offered pay-over-time options from Affirm, Klarna or Afterpay (Clearpay). Those services are provided by those companies under their own terms, credit checks and fees, not by Custom Cult. Whether you are approved is their decision. If we refund an order paid with one of these services, we refund through that service, and any remaining balance or fees are governed by your agreement with that provider.
Production timing and ship estimates
Custom boards are built in scheduled production runs. Before you pay, the board designer and checkout show an estimated ship window for your order. Plan on roughly 6 to 8 weeks from order to shipment. This is a good-faith estimate, not a promise. Once your order is assigned to a run, your order page and our emails show a ship window for that run.
We promise a ship date range, not a delivery date. Carrier transit time is outside our control.
If we learn that we cannot ship within the window we last told you, we will email you a revised window. If the revised window is more than 30 days later than the last one we told you, or if you do not want to wait, you may cancel that order for a full refund even if production has started.
Cancelling your order
You may cancel a custom board order yourself from your order page, for a full refund to your original payment method, for as long as your order page shows the "Cancel order" button. That is up to the day before your production run starts, measured at the end of that day in Coordinated Universal Time (UTC).
After that deadline your board is being built for you and cannot be cancelled or changed. Contact us and we will help where we reasonably can, but we are not obliged to cancel, change or refund an order once production has started, except as described in the sections on ship delays and defects.
An order with more than one board has one cancellation deadline and ships together.
Custom boards are not returnable
Each custom board is made to your specifications and clearly personalised. For that reason custom boards are not returnable and are not refundable for change of mind, fit preference, or a mistake in the information you entered. This applies once production has started.
If you live in the European Union, the United Kingdom or another place with a right to withdraw from distance sales, please note that this right does not apply to goods made to your specifications or clearly personalised (for example, Article 16(c) of the EU Consumer Rights Directive and the equivalent UK rule). By placing an order for a custom board you acknowledge that the board is made to your specifications and that you will not have a right to withdraw once production has started. Nothing in this section limits your legal rights if the board is faulty.
Limited warranty and what we do if something is wrong
We stand behind every board we build. This is a Limited Warranty.
What is covered. We warrant to the original purchaser that your custom board will be free from defects in materials and workmanship for 1 year from the date it is delivered. Damage in transit is covered if you report it to us within 7 days of delivery with photos.
What is not covered. Normal wear; damage from impacts, rocks, rails, improper mounting, incorrect binding setup, heat, storage, modification or repair by anyone other than us; cosmetic variance in printed graphics (see the graphics section); and a board that matches the specifications you entered.
What we will do. If a covered defect appears, contact us from your order page ("Get help with your board") and describe what happened, with photos. We will, at our option, repair the board or remake it. If we cannot reasonably repair or remake it, we will refund the price you paid for the board, or offer store credit if you prefer. We may ask you to return the board and will provide a prepaid return label. Repair or replacement is your exclusive remedy for a defect, except where the law gives you more.
How to make a claim. Use the "Get help with your board" link on your order page, or the Contact page. Keep the board and packaging until we have responded.
Implied warranties. TO THE EXTENT THE LAW ALLOWS, ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED TO THE DURATION OF THIS LIMITED WARRANTY. Some states and countries do not allow limits on how long an implied warranty lasts, so this limit may not apply to you. This warranty gives you specific legal rights, and you may also have other rights that vary from place to place. Consumers in the EU and UK have a legal guarantee of conformity that this section does not reduce.
Store credit
We sometimes issue store credit, for example as a goodwill resolution of a help request or as a gift. Store credit has no cash value, cannot be transferred or sold, and can only be applied to purchases on the Service by the account it was issued to.
If we owe you a refund, you choose between a refund to your original payment method and store credit. We issue credit in place of a refund only when you choose it. Credit issued in place of a refund may include an extra goodwill amount. The part equal to the refund you were owed never expires. Any extra goodwill amount, and credit issued as a gift, expires 365 days after it is issued unless the credit says otherwise. We will email you before any credit expires.
Credit is applied at checkout before your card or pay-over-time provider is charged. If an order that used credit is cancelled or refunded, the credit is restored to your account.
Graphics you upload or generate
You can put your own artwork on your board or, when the AI tool is available, generate artwork with it. AI images are created by third-party models; our Privacy Policy names the companies that run them.
Your rights and promises. You keep any copyright you hold in artwork you upload or in your prompts. You promise that you own or have permission to use everything you upload, and that neither your uploads nor your prompts target or copy identifiable third-party intellectual property (for example another brand's logos, characters or trademarks) or the likeness of a real person without their permission. You may not upload or request content that is illegal, sexual, hateful, harassing, or that infringes another person's rights.
Licence to us. So that we can build, show and ship your board, you give Custom Cult a worldwide, royalty-free licence to store, reproduce, adapt (for example to fit the board, add bleed, enlarge for printing, or generate previews), print and display your artwork and prompts in connection with your designs and orders, to show your saved designs through share links you or we create, and to let the service providers who work for us do these things on our behalf. This licence continues for boards already ordered and for share links you created, even after you close your account.
Community reuse of AI images. AI images are created by a third-party model. They are not unique to you, they may not be protected by copyright under current US Copyright Office guidance, and another rider may receive a similar image. When the AI tool is available, you will be asked once, before your first generation, to acknowledge the rules in this paragraph. We record your acknowledgement, and if you do not agree you cannot use the AI tool. An AI image you generate but do not purchase on a board may, after a waiting period, be reviewed by us and added to our public graphics library, credited to Custom Cult, for other riders to use. If you buy any board, AI images you generated earlier and never saved become eligible at once. An image you have purchased on a board is never added to the library, and if you later buy a board with an image that was added, we remove it from the library unless someone else already has a design that uses it. Images generated from a photo you uploaded are never added to the library.
Print variance. Colours on screen and in print differ. Part of your graphic (about 25 mm at each edge) is trimmed as bleed during manufacturing. Small differences in colour, position and cropping between the preview and the finished board are normal and are not defects. Previews are watermarked; your finished board is not.
Moderation and our right to refuse. We may review, refuse, hide, watermark, or remove any image, prompt, design, shared board, gallery entry, or designer offering at any time, with or without notice, if we believe it breaks these Terms, infringes anyone's rights, or is something we do not want to print. We are not obliged to print any design. If we refuse to print artwork on a board you have ordered, we will tell you and give you the choice of replacing the artwork or cancelling the order for a full refund of the board price. If we learn after a board has shipped that its artwork infringed someone's rights, we may be required to stop using the artwork in previews, share images, and the gallery, and you agree to cooperate; you remain responsible for artwork you supplied. We may suspend accounts that submit prohibited content.
Community features
You may react to graphics, take part in graphic match-ups, and cheer designers. These signals help us order what riders see. You may not use bots, multiple accounts, paid engagement or coordinated activity to manipulate reactions, cheers, rankings or commissions. We may discard suspect signals and suspend the accounts involved.
Referral program
Sharing a design or a designer link can earn a commission when someone buys through it, as described in the Designer program section. To earn commissions you must be a designer with a connected payout account. Referral tracking uses a cookie that lasts 30 days on a last-touch basis. Self-referrals do not earn commission. Commissions are reversed if the order is cancelled or refunded. We may change referral rates, tracking windows and eligibility going forward, and we may withhold or reverse commissions we reasonably believe came from fraud, self-dealing or a breach of these Terms. If you promote Custom Cult and could earn from it, you must clearly disclose that relationship where you post (for example "I earn a commission if you buy through my link"), as US Federal Trade Commission rules require.
Designer program
This section applies if you become a designer. It adds to the rest of these Terms.
Becoming a designer. You become a designer by opening a designer profile and accepting these Terms in that flow. Your first algorithm is derived from a board you purchased. We may also invite you to become a designer based on a design you created; if we invite you, we will ask for your agreement by email before your profile goes live.
What an algorithm is. An algorithm is a set of parameters we derive from a board you designed and bought, using our calculation engine. It biases the geometry of boards other riders build under your name. The parameters, and the method used to derive them, are trade secrets of Custom Cult and stay on our servers.
Ownership and licence. You keep any copyright in original artwork you create. You agree that the algorithm parameters derived from your board are owned by Custom Cult, and you grant Custom Cult a perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, adapt and display your board design, the artwork you offer with your algorithm, your display name, avatar, bio and home mountain, for the purpose of producing, listing, ranking, marketing and selling boards built under your algorithm, including after you leave the program for boards already sold.
Independent relationship. You take part as an independent participant, not as our employee, agent, partner or joint venturer. You have no authority to bind us. You are free to work with anyone else. We do not control when or how you promote your profile.
Commissions. When a board built under your algorithm sells, you earn a commission calculated on the order subtotal (before tax and shipping) at the rate for your tier at the time the sale was attributed, multiplied by your share under our two-slot model: 100% if you both shared the link and own the algorithm; 60% to the person who shared the link and 40% to the algorithm designer when they are different people. Launch tiers are Casual 5%, Active 10% and Pro 15%, moving up automatically as sales are attributed to you (Active at 5 lifetime sales, Pro at 25); we may agree a different rate with you in writing. Rates and tiers may change going forward; a sale already attributed keeps the rate it was attributed at.
When you are paid. Commissions are held until the order is delivered plus 7 days, then transferred through Stripe Connect to the payout account you connect. You must complete Stripe Connect Express onboarding, verify your email and accept the current version of these Terms before we can pay you; commissions still accrue while you do. Stripe's terms apply to your connected account. We do not pay in cash or by other means.
Reversals and negative balances. If an order is cancelled, refunded or charged back, the commission on it is reversed. If we already paid you, the amount is recorded as a debt on your designer account and deducted from your next commissions until cleared. We do not charge your bank account for it.
Taxes. You are responsible for all taxes on your commissions. Stripe or we may collect tax information and issue tax forms (for example a Form 1099) where the law requires.
Your promises. You promise that your profile, artwork, offered graphics and name do not infringe anyone's rights, that you are at least 18, and that you will not use your profile to mislead riders. You will not promote your algorithm as a "pro" or professional product unless that is true.
Trade-secret confidentiality. Our calculation-engine math is a protected trade secret. You agree not to attempt to extract, reverse-engineer, or disclose it.
Status changes. We may promote, demote, pause, suspend, or terminate a designer account and adjust commission tiers in accordance with our marketplace policies, including for repeat infringement. We may pause a profile while we review suspected fraud or a copyright complaint; commissions earned while paused are held, not forfeited, unless we find a breach.
Leaving the program. You may stop participating at any time by asking us to pause or close your profile. Boards already sold under your algorithm stay sold, and commissions already earned are paid under this section. We may keep using your algorithm for boards already ordered, and may keep your display name on those orders.
Acceptable use
You agree not to misuse the service. In particular you will not: (a) access the service by any automated means, including bots, scrapers, crawlers or scripts, or send requests to our calculation, preview or image endpoints other than through the design tool as a person using it; (b) probe, sample or otherwise attempt to reconstruct, reverse engineer, decompile or derive the calculation engine, the designer algorithms, or any pricing, ranking or recommendation logic from the service's outputs; (c) copy, frame, mirror or reproduce the service or any substantial part of its design, content, imagery or data, or use any of them to build, train or improve a product or service that competes with Custom Cult; (d) circumvent, disable or interfere with rate limits, access controls, watermarks or other protective measures; (e) attempt to disrupt or gain unauthorized access to our systems or another person's account; or (f) use the service to infringe another person's rights. We may suspend or terminate access and pursue any available remedy for a breach of this section.
Intellectual property
All Custom Cult trademarks, branding, software, and the calculation engine are owned by Custom Cult and protected by intellectual-property and trade-secret law. These Terms do not grant you any rights in them except as expressly stated.
The calculation engine, the designer algorithms and their parameters, and the methods by which they are derived are trade secrets of Custom Cult. Board dimensions shown to you are provided for your purchase and use of your own board only. Nothing in the service is an invitation to study, test or measure the service for the purpose of duplicating it.
Copyright complaints
If you believe content on the Service infringes your copyright, send a notice with the information required by the US Digital Millennium Copyright Act to our copyright agent: Custom Cult LLC, Attn: Copyright Agent, 900 Roma Ave NW, Albuquerque, NM 87102, USA, or dmca@customcult.com. We remove or disable access to content identified in a valid notice, tell the person who posted it, and accept counter-notices under the statutory process. We terminate the accounts of repeat infringers.
Snowboarding risks and your safety
Snowboarding is dangerous. Falls, collisions, terrain, weather and equipment failure can cause serious injury or death. You are responsible for riding within your ability, using proper bindings and boots correctly mounted for your board, inspecting your equipment before each use, and following the rules of the mountain. Nothing in these Terms limits our liability for death or personal injury caused by our negligence or by a defective product where the law does not allow that liability to be limited.
Disclaimers
Except for the Limited Warranty above, the Service and everything we sell are provided "as is" and "as available." To the extent the law allows, we make no other promise about the Service, including that it will be uninterrupted, error-free or secure, that a design preview will match the finished board exactly, or that a board will suit your riding style or ability. Ship estimates, designer rankings, "pro" and tier labels, and community signals are provided for information and are not promises.
Limitation of liability
To the extent the law allows, Custom Cult and its owner, employees and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from these Terms, the Service or any product, however caused. To the extent the law allows, our total liability to you for all claims relating to an order is limited to the amount you paid for that order, and for all other claims to one hundred US dollars (US$100).
These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by our negligence, for fraud, or for a defective product where the law prohibits the limit. Some places do not allow some of these limits, so some may not apply to you.
Your responsibility to us
You agree to defend and hold Custom Cult harmless from claims, losses and reasonable legal costs arising from artwork, prompts or content you provide, your breach of these Terms, or your infringement of another person's rights. This does not apply to consumers where the law does not allow it.
Suspension and termination
We may suspend or close your account, cancel orders we have not accepted, hold or reverse commissions, or remove content if we reasonably believe you have broken these Terms, the law, or another person's rights, or if we are required to. Orders we have accepted and paid commissions are handled under the sections above. You may close your account at any time. Sections that by their nature should survive (including licences, payment obligations, disclaimers, limitations, indemnity and dispute resolution) survive termination.
Dispute resolution and governing law
These Terms and any dispute between you and Custom Cult are governed by the laws of the State of New Mexico and the federal laws of the United States, without regard to conflict-of-laws rules, except that if you are a consumer in the EU, UK or another country whose law gives you protections that cannot be waived, you keep those protections.
Before filing a claim, you agree to contact us through the Contact page or at legal@customcult.com and give us 30 days to resolve the problem informally; we will do the same before filing against you. Any claim that is not resolved will be brought in the state or federal courts located in Bernalillo County, New Mexico, and you and we consent to their jurisdiction. Either of us may instead bring a qualifying claim in small claims court where you live. Consumers outside the United States may also bring claims in the courts of their home country where the law gives them that right.
General terms
Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, fire, flood, severe weather, epidemic, war, civil unrest, labor disputes, supplier or carrier failures, utility or internet outages, or government action. We will tell you about a delay that affects your order and the ship-delay section applies.
Changes to the Service. We may change or discontinue features of the Service. Orders already accepted are not affected.
Entire agreement. These Terms, the Privacy Policy and the order confirmation for each order are the whole agreement between you and Custom Cult about their subject and replace any earlier understanding. Stripe, Affirm, Klarna, Afterpay and other third parties have their own terms with you.
Severability. If a court finds part of these Terms unenforceable, the rest stays in force and the unenforceable part is replaced with the closest enforceable term.
No waiver. Our not enforcing a term is not a waiver of it.
Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor that takes over the business, and will tell you if we do.
Notices. We send notices to the email on your account or order. You send notices to us through the Contact page, by email to legal@customcult.com, or by mail to the address below.
Language. These Terms are written in English. A translation is for convenience only.
Changes to these Terms
We may update these Terms. When we do, we post the new version with a new version number and effective date at the top of this page. For material changes we will also email account holders or show a notice in the Service at least 14 days before the change takes effect, and we may ask you to accept the new version before you place a new order or, for designers, before your next payout. Changes do not apply to an order you placed before the change took effect. If you do not agree to a change, stop using the Service and, if you are a designer, ask us to close your profile.
